Terms of Service

Article 1 (Application)
These Terms of Service ("Terms") set forth the conditions for using all services ("Services") provided by discowiki ("Site"). Users must use the Services in accordance with these Terms.
Article 2 (Definitions)
The definitions of terms used in these Terms are as follows:
- "User": All persons using the Services
- "Registered User": Persons who have logged into the Services using a Discord account
- "Content": All information provided on the Services, including articles, comments, and images
- "Contributor": Registered users who have the authority to post articles on the Site
- "Administrator": The operator of the Site
Article 3 (Prohibited Acts)
Users must not engage in the following acts when using the Services:
- Acts that violate laws or public order and morals
- Acts that infringe on the intellectual property rights of other users, third parties, or the Site
- Acts that infringe on the property, privacy, or portrait rights of others
- Acts of defamation or slander against others or the Site
- Acts of sending spam, chain mail, viruses, or other harmful programs
- Acts that place excessive load on the Site's servers
- Acts that interfere with the operation of the Site
- Other acts deemed inappropriate by the Site
Article 3-2 (Prohibition of AI/Machine Learning)
Users and third parties are prohibited from engaging in the following acts regarding all content posted on the Site (articles, images, text, data, etc.):
- Using as training data for AI (Artificial Intelligence)
- Collecting and using as training data for machine learning models
- Using as prompts for generative AI, etc.
- Any other use of the Site's content for the development, improvement, or operation of AI-related technologies
Article 3-3 (Response to Violations)
In the event of a violation of these Terms, the Site may take the following measures:
- Suspension or deletion of discowiki account
- Demand cessation of the violating act
- Claim for damages (including damages caused by AI training)
- Report or file charges with police and other relevant authorities
- Other necessary actions including legal measures
Article 3-4 (Penalty)
If a User violates Article 3 or Article 3-2 of these Terms, the Site may claim the following penalties depending on the nature of the violation:
- Copyright infringement / AI learning violation: ¥500,000 per incident
- Defamation / slander: ¥300,000 per incident
- The penalties above do not preclude claims for damages if the actual damage exceeds the penalty amount. Additionally, the violator shall bear the costs incurred by the Site for investigation (including attorney fees, server log analysis costs, etc.).
Article 4 (Comments)
Users should note the following when posting comments:
- Comments will be published after administrator approval
- Comments deemed inappropriate may not be approved
- Copyright of posted comments belongs to the poster, but the Site may use them free of charge
- The poster is responsible for the content of their comments
Article 4-2 (Posted Content (Articles))
Contributors must comply with the following when posting articles:
- Contributors bear sole responsibility for the content of their posted articles
- Intentionally false information, exaggerations, or misleading content must not be posted
- When quoting from other websites, books, or news sources, the source (URL, book title, etc.) must be clearly cited
- Unauthorized reproduction of third-party copyrighted material (text, images, videos, etc.) is prohibited
- The following types of content are prohibited: false or misleading information, unauthorized disclosure of personal information, unjust attacks or defamation of individuals or organizations, content harmful to minors, political or religious solicitation or propaganda, and spam or promotional content
- Submitted articles are subject to review by a reviewer or administrator before publication. Articles may be withheld from publication as a result of review
- The Site reserves the right to modify, delete, or unpublish posted content without prior notice due to policy violations, factual errors, or other operational reasons
- Contributors warrant that their posted content does not infringe the rights of any third party (including copyright, portrait rights, and privacy rights)
Article 5 (Disclaimer)
The Site assumes no responsibility for the following:
- Accuracy, completeness, or usefulness of information posted on the Services
- Troubles between users or between users and third parties
- Damages resulting from suspension, interruption, or termination of the Services
- Troubles related to content posted by users
- Issues related to the Discord service itself
- This site is an unofficial fan site with no affiliation to Discord Inc.
Article 6 (Copyright)
The copyright of content posted on the Site shall belong as follows:
- The copyright of articles created by contributors belongs to the contributor who created the article
- The copyright of the Site's logo, design, system, etc. belongs to the discowiki management team
- By posting an article on the Site, the contributor is deemed to have granted the Site a non-exclusive, royalty-free license to display and distribute the article on the Services
- The Site may reproduce, adapt, or translate posted content to the extent necessary for the operation, improvement, and promotion of the Services
- Contributors warrant that they do not infringe on the copyrights of third parties
- The provisions of the preceding paragraphs do not prevent contributors from exercising their rights under copyright law
Article 7 (Service Changes/Suspension)
The Site may change the content of the Services or suspend the provision of the Services without prior notice to users.
Article 8 (Changes to Terms)
The Site may change these Terms in accordance with the following procedures:
- The Site may change these Terms when deemed necessary
- In the case of significant changes, a notice period of at least 30 days shall be provided on the Site or official Discord server before the change takes effect
- Minor changes shall take effect from the time they are posted on the Site
- If you do not agree to the revised Terms, please discontinue use of the Services
Article 9 (Governing Law/Jurisdiction)
These Terms shall be governed by the laws of Japan. In the event of a dispute regarding the Services, the court with jurisdiction over the location of the Site shall have exclusive jurisdiction.
